During the colonial period in British India, the British authorities enacted the Land Acquisition Act of 1894 as legislation. The Land Acquisition Act of 1894 provided a legal framework for the government to acquire land from individuals or communities, even against their will, in exchange for compensation.

Definition of Public Purpose: The act defined “public purpose” broadly to include projects that aimed at providing public benefits such as the construction of roads, railways, schools, hospitals, and other infrastructure facilities.

Acquisition Process: The act lays down the procedures and steps to follow for land acquisition. It included the issuance of notifications, conducting surveys, and assessment of compensation. Also, the opportunity for affected individuals to present their objections.
Compensation: The act specifies that the affected landowners have the entitlement to receive compensation for their land. Also, the act determines the compensation based on the market value of the land at the time of acquisition. Moreover, including the value of structures, trees, and other improvements on the land.

Land Acquisition Officers: The act established the position of Land Acquisition Officer, who was responsible for implementing the provisions of the act in a particular region. The officer had the authority to make decisions on land acquisition and compensation matters.
Dispute Resolution: The act provided provisions for resolving disputes related to land acquisition through arbitration. It also allowed affected individuals to seek judicial remedies in case of grievances or dissatisfaction with the compensation awarded.

The Indian government enacted the Right to Fair Compensation and Transparency in Land Acquisition. And Rehabilitation and Resettlement Act, 2013, which repealed the Land Acquisition Act of 1894. And introduced more comprehensive provisions for land acquisition, compensation, and rehabilitation of affected persons.
